Terms of Use

The short version. TerraIQs sells parcel due-diligence dossiers compiled from public data. The dossiers are an information product — not legal, financial, surveying, or real-estate advice. Don't buy land based on a TerraIQs report alone; verify everything with the appropriate professionals first. If you keep using the site, you're agreeing to these terms.

1. About these Terms

These Terms of Use ("Terms") form a binding agreement between you and TerraIQs (also "we," "us," or "our") covering your use of terraiqs.com, the dossiers and tools we make available through it, and any related services (together, the "Service"). By creating an account, paying for a dossier, or otherwise using the Service, you agree to these Terms and to our Privacy Policy.

If you don't agree, please don't use the Service.

2. What TerraIQs is

TerraIQs is a parcel-level due-diligence tool for rural Texas land. The dossiers blend public datasets — county appraisal-district records, FEMA flood maps, USGS elevation tiles, USDA soil surveys, TxDOT road and traffic data, Texas Railroad Commission well and pipeline data, US Census population estimates, and others — into one report for a single parcel.

What TerraIQs is not. The dossiers are an information product. They are not a title commitment, survey, appraisal, environmental site assessment, legal opinion, investment advice, or real-estate recommendation. The underlying public datasets are typically 6–18 months stale and may contain mapping errors. They do not reflect unrecorded easements, deed restrictions, mineral or surface estate splits, water rights, HOA covenants, tax delinquency, pending litigation, or any other condition that only shows up in physical inspection, title work, or court records.

Always verify with qualified professionals before any acquisition or financing decision. If you treat a TerraIQs dossier as a substitute for a survey, title commitment, attorney review, or licensed appraisal, you are using the Service in a way it was not designed for.

3. Eligibility and accounts

  • You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service.
  • You must provide accurate sign-in information and keep it up to date.
  • You're responsible for keeping your account secure. Don't share your sign-in link or session, and tell us right away at contact@terraiqs.com if you think someone else has accessed your account.
  • One account per person. Don't create accounts to evade trial limits, payment, or a suspension.

4. Acceptable use

You agree not to:

  • Scrape, crawl, or otherwise programmatically extract dossiers or other content from the Service without our written permission.
  • Resell, republish, or redistribute dossiers in bulk, repackage them as a competing product, or strip out TerraIQs branding.
  • Use the Service to harass, surveil, or harm a property owner. Owner names and addresses in dossiers come from public county records and may be used to evaluate a parcel — not to contact owners in violation of TCPA, CAN-SPAM, no-call lists, or similar laws.
  • Attempt to reverse-engineer, decompile, or extract source code, models, or proprietary scoring methodology from the Service.
  • Interfere with the Service's operation, probe for vulnerabilities without authorization, or attempt to access another user's account.
  • Use the Service in any way that violates applicable law (including export controls, sanctions, anti-discrimination, and fair-housing laws).

We may suspend or terminate accounts that violate this section without refund.

5. Dossiers, credits, and subscriptions

How purchases work

  • New accounts get a small number of free dossier views to evaluate the Service. After those run out, viewing a new parcel requires credits or an active subscription.
  • Credits and subscription plans are described on the Pricing page. Prices, plans, and the number of included reports may change; existing subscriptions are billed at the price you signed up at until your next renewal.
  • Re-viewing a parcel you've already opened is free for the lifetime of your account.

Payments

  • All charges are processed by Stripe. By providing payment information you authorize us (through Stripe) to charge you for the credits or subscription you select.
  • Subscriptions auto-renew at the end of each billing period until you cancel. You can cancel at any time from your account page; cancellation takes effect at the end of the current billing period.
  • You're responsible for any sales tax, VAT, or similar tax that applies to your purchase.

Refunds

  • Per-dossier purchases are non-refundable once the dossier has been generated. If a charge appears in error (duplicate, never-delivered, or wrong amount), email contact@terraiqs.com within 30 days and we'll investigate.
  • Subscriptions are not refunded mid-cycle, but you can cancel future renewals from your account page or by emailing us.
  • Nothing in this section limits any non-waivable refund rights you have under applicable consumer-protection law.

6. License to use dossiers

When you purchase a dossier, we grant you a non-exclusive, non-transferable license to view, download, print, and share that dossier for your own due-diligence purposes — including sharing with your real-estate agent, attorney, lender, accountant, business partner, family member, or buyer/seller of the same parcel.

You may not: (a) resell the dossier or any substantial portion of it as a standalone product, (b) remove or alter TerraIQs branding or the "important — read before acting" disclaimer, or (c) use dossiers as inputs to train a competing automated valuation or due-diligence model.

7. Intellectual property

The TerraIQs name, logo, dossier templates, scoring methodology, software, and the editorial layer we add on top of public data (commentary, summaries, narratives, recommendations) are owned by TerraIQs and protected by intellectual-property laws. Public-domain data we incorporate (Census, USGS, USDA, FEMA, TxDOT, etc.) remains under its original public-domain or open-data terms.

8. Your content and feedback

If you submit messages, chat conversations, contact-form notes, or feature requests, you grant TerraIQs a worldwide, royalty-free, non-exclusive license to use that content to operate and improve the Service. We won't publicly identify you as the source of any feedback without your permission. You confirm that anything you submit is your own to share.

9. Third-party services

The Service relies on third-party services (Google, Stripe, Anthropic, Fly.io, Tigris, Sentry, and others — see the Privacy Policy). Your use of those services through TerraIQs is also subject to their own terms. We're not responsible for outages, errors, or changes to third-party services, but we will make reasonable efforts to keep TerraIQs working when an upstream service has problems.

10. Disclaimers

THE SERVICE AND THE DOSSIERS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND — EXPRESS, IMPLIED, OR STATUTORY — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPLETENESS, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

WE DO NOT WARRANT THAT THE PUBLIC DATA UNDERLYING THE DOSSIERS IS CURRENT, COMPLETE, OR FREE OF ERRORS. WE DO NOT WARRANT THAT ANY DOSSIER ACCURATELY DESCRIBES THE LEGAL, PHYSICAL, ENVIRONMENTAL, OR FINANCIAL STATE OF A PROPERTY. TERRAIQS IS NOT A REAL-ESTATE BROKER, ATTORNEY, SURVEYOR, APPRAISER, ENVIRONMENTAL CONSULTANT, OR LICENSED FINANCIAL ADVISOR, AND NOTHING IN A DOSSIER CONSTITUTES PROFESSIONAL ADVICE IN ANY OF THOSE AREAS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TERRAIQS AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOST OPPORTUNITIES, LOST GOODWILL, OR DAMAGES FROM PROPERTY-PURCHASE DECISIONS MADE IN RELIANCE ON A DOSSIER — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TERRAIQS IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF CERTAIN DAMAGES; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless TerraIQs and its owners, employees, contractors, and affiliates from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising from: (a) your violation of these Terms, (b) your misuse of the Service or any dossier, (c) your violation of any applicable law, or (d) your acquisition, financing, or disposition decisions for any property based in whole or in part on a TerraIQs dossier.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or use the Service in a way that creates legal or operational risk for us or other users. Sections of these Terms that by their nature should survive termination — including disclaimers, limitations of liability, indemnification, intellectual-property ownership, and governing law — will survive.

14. Changes to the Service or these Terms

We may modify the Service (add features, retire features, change pricing) at any time, with reasonable notice for material changes. We may also update these Terms; if we do, we'll update the "Last updated" date and, for material changes, send an email or post a notice in the app. Continued use after a change means you accept the updated Terms. If you don't accept them, your option is to stop using the Service.

15. Governing law and disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws principles. Any dispute that can't be resolved by good-faith discussion will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to that jurisdiction and venue. Nothing in this section limits your right to bring a claim in small-claims court for an amount within that court's jurisdictional limit.

16. Miscellaneous

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and TerraIQs about the Service, and supersede prior agreements about the same subject.
  • Severability. If any provision is found unenforceable, the rest stays in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign these Terms. We may assign them as part of a business transfer or reorganization.
  • Notices. We give notices through in-app messages or to the email address on your account. Notices to us must go to contact@terraiqs.com.
